By accessing or using thecaregiverfiles.com, you agree to these terms. If you do not agree, do not use this site.
This site exists to provide information about The Caregiver Files products and to route buyers to the correct product for their situation. You may use this site for lawful purposes only. You may not attempt to interfere with the site's operation, scrape content for commercial use, or misrepresent your identity or affiliation.
This site links to third-party platforms including Payhip (for product delivery) and Tally (for the situation quiz). Your use of those platforms is governed by their own terms of service. The Caregiver Files is not responsible for the policies or practices of third-party platforms.
This site and its content are provided "as is." The Caregiver Files makes no warranties, expressed or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content on this site. The organizational documents sold through this site are tools to help caregivers manage information. They do not constitute legal, medical, or financial advice.
To the fullest extent permitted by law, The Caregiver Files shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this site or the products sold here. Total liability for any claim shall not exceed the amount you paid for the product in question.
These terms may be updated at any time. Continued use of the site after changes are posted constitutes acceptance of the revised terms. The effective date at the top of this section reflects the most recent update.
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these terms or your use of this site shall be resolved exclusively in the state or federal courts located in San Bernardino County, California, and you consent to the personal jurisdiction and venue of those courts.
Questions about these terms can be sent to the contact address on file with Payhip. The Caregiver Files does not publish a direct contact address to protect the privacy of the anonymous brand.
Section 02

This agreement applies to all purchases made through The Caregiver Files store on Payhip. By completing a purchase, you agree to these terms.
You are purchasing a set of digital files in Microsoft Word format (.docx). Depending on the product selected, your purchase includes some combination of the following files:
No physical product will be shipped. No access to a course, membership, or ongoing service is included.
Files are delivered via Payhip immediately after purchase. You will receive a download link by email. If you do not receive your files within 24 hours, contact Payhip support directly.
All sales are final. Because these are digital files that are accessible immediately upon purchase, no refunds will be issued under any circumstances.
Before purchasing, you are encouraged to read the product description carefully and use the free Caregiver Situation Quiz at tally.so/r/jaz2Yx to confirm you are selecting the correct version for your situation.
Filing a chargeback or payment dispute for a digital product you have received constitutes a violation of this agreement. The Caregiver Files reserves the right to contest any chargeback with documentation of delivery.
Buyers receive free lifetime updates to the files they purchased. When updated versions are available, they will be accessible through Payhip. The Caregiver Files does not guarantee a specific update schedule.
This agreement is governed by the laws of the State of California.
Section 03

When you purchase a product from The Caregiver Files, you are granted a limited, non-exclusive, non-transferable license to use the files as described below.
All files, templates, scripts, and content created by The Caregiver Files remain the intellectual property of The Caregiver Files. Purchase grants you a use license only. Ownership of the underlying content is not transferred.
Violations of this license may result in termination of your license to use the files and potential legal action. The Caregiver Files reserves all rights not expressly granted in this agreement.
This license is governed by the laws of the State of California.

These terms govern The Caregiver Files App, available at thecaregiverfiles.com/app and thecaregiverfiles.com/app/app.html (the "App"). By creating an account, using the App, or activating an unlock key, you agree to these terms. If you do not agree, do not use the App.
The App is an organizational logbook for family caregiving. It stores information that you and the people you invite choose to enter: medication schedules and logs, daily care notes, shift handoff notes, and related records. The free tier includes solo logging and the Emergency First Response Sheet builder. A paid unlock adds shared features: invite links, shift handoffs, and the full library of conversation guides.
The App is not a medical device and does not provide medical, legal, or financial advice. It does not check doses, detect drug interactions, monitor anyone's health, or alert anyone to danger. It is a place to write things down. In an emergency, call 911. For medical decisions, talk to a licensed medical professional.
You are responsible for the accuracy of the information you and your care circle enter, and for reviewing it before relying on it. The App displays what was typed into it. It does not verify medication names, doses, schedules, or anything else. All caregiving and medical decisions remain with you, your family, and the licensed professionals involved in your parent's care.
You must provide a working email address and keep your password to yourself. You are responsible for activity that happens under your account. If you believe your account has been accessed without permission, change your password immediately.
Invite links let other people see and, depending on the role you assign, add to your parent's care records. You decide who gets an invite. Anyone you invite as a caregiver or viewer will see the care information in that circle. Choose carefully. The Caregiver Files is not responsible for what invited members do with information they can see.
The unlock is currently $49 for one year, offered as a founding price. Pricing is not guaranteed and may change for future purchases or renewals. The unlock is a one-time license key purchase through Payhip, not an auto-renewing subscription; nothing charges your card automatically. One key covers one care circle. Keys that are refunded or charged back are deactivated, and the unlock features they enabled are removed.
All sales are final, consistent with the Digital Product Purchase Agreement above.
The App is provided "as is" and "as available," without warranties of any kind, expressed or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. The App is built on developing technology and may carry risks that are not present in older, more established tools. The Caregiver Files does not warrant that the App will be error-free, secure, or continuously available, and does not guarantee any particular outcome from using it.
The App depends on third-party providers, including Supabase (data hosting and accounts), Payhip (payments and license keys), and web hosting and payment processors. The Caregiver Files does not control the pricing, availability, terms, or continuity of these providers. If a provider changes its terms, raises its prices, suffers an outage, or discontinues a service the App depends on, the App may be interrupted, changed, or discontinued. The Caregiver Files will make reasonable efforts to keep the App running and to give notice of material changes, but does not guarantee the future availability of any third-party service.
How the App collects, stores, and protects information is described in the Privacy Policy, which is part of these terms. Short version: your data is yours, it is used only to run the App, and it is never sold.
You can stop using the App at any time and can request deletion of your account and its data. The Caregiver Files may suspend or terminate accounts that violate these terms, abuse the service, or interfere with other users. If the App is ever discontinued, reasonable efforts will be made to provide notice and a window to retrieve your information.
To the fullest extent permitted by law, The Caregiver Files shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, lost opportunities, or the cost of substitute services, arising from or related to the App, even if advised of the possibility of such damages. This includes damages arising from information entered into the App being wrong, incomplete, or unavailable when needed.
Total liability for all claims related to the App shall not exceed the amount you paid for the App in the twelve months before the event giving rise to the claim.
You agree to hold The Caregiver Files harmless from claims arising out of your misuse of the App, your violation of these terms, or your violation of another person's rights, including the privacy rights of the person whose care is being recorded.
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these terms or the App shall be resolved exclusively in the state or federal courts located in San Bernardino County, California, and you consent to the personal jurisdiction and venue of those courts. If any provision of these terms is found unenforceable, the remaining provisions stay in effect.
These terms may be updated as the App changes. Material changes will be reflected in the effective date above. Continued use of the App after changes are posted constitutes acceptance of the revised terms.
